Do you need a Standard Rules Environmental Permit for Waste?

If you carry out waste activities which fall under the Environmental Permitting Regulations 2016 , you may need an Environmental Permit. 

There are two types of Environmental Permit: 
1) Standard Rules
2) Bespoke 

The type of environmental permit you need with depend on the activities you plan to carry out. 
Here is a quick overview of Standard Rules Permits , what they are and the cost factors involved. 




KEY POINTS

You cannot vary or change any of the rules within a Standard Rules Environmental Permit.

If the local environment changes after you have been granted a Standard Rules Permit , you may need to upgrade to a Bespoke Permit.

If you cannot meet the standard rules or if your site does not been the criteria , your application will be refused.

What is a Standard Rules Permit?

A Standard Rules Permit is a type of Environmental Permit with rules which cannot be changed. The risks have already been assessed by the Environment Agency to put set conditions into place for operators to follow.

These types of Environmental Permits streamline the application and regulation process.

Can I carry out any activity with a Standard Rules Permit?

Conditions (rules) within the Standard Rules permits are set , these include the management , operations , waste types , quantities and waste storage requirements. Therefore , you must make sure your activities meet all the requirements before apply for a Standard Rules permit

Can I have a Standard Rules permit anywhere?

Standard Rules Permits set out location requirements based on the assessed risks. Therefore you will not be able to carry out certain activities within a specific radius of sensitive receptors such as protected sites and water supplies. It is important that site screening is carried out before you apply for a Standard Rules Permit.

What is the cost of a Standard Rules Permit for Waste?

The cost of a Standard Rules permit varies depending on the activities you want to carry out.

In general , permit application costs include (but is not limited to) :

  • Application Fee
  • Fees to assess plans (eg FPP)
  • Subsistence Fees
  • Transfer Fees
  • Surrender Fees
  • Consultant Fees (If you choose to use one)

What types of Standard Rules Permits are there?

  • Anaerobic digestion including use of the resultant gas and storing digestate
  • Car and vehicle dismantling

  • Composting, sewage or sludge treatment, biogas

  • Flood risk activities
  • Medium combustion plant and specified generators
  • Metal recycling, scrap metal and WEEE - not cars or vehicles
  • Metal recycling, scrap metal and WEEE - not cars or vehicles - unavailable for new applications
  • Mining, oil and gas
  • Mobile plant for land-spreading or treatment
  • Radioactive substances for non-nuclear sites
  • Storage or treatment of waste - recycling, dredging, clinical, soil, tyre shred or wood treatment
  • Storage or treatment of waste - recycling, dredging, clinical, soil or wood treatment - unavailable for new applications
  • Waste transfer station or amenity site with or without treatment

If you currently hold a T9 Waste Exemption for the Recovery of Scrap Metal , you will be aware that this is to be removed in 2025. Waste exemptions are changing , and one of the big changes set to come into force is the revocation of the the T9 Recovery of Scrap Metal Exemption. The changes are due to come into place in 2025 , however this is dependent on various political factors , so as yet no specific deadline has been set. To remedy the removal of the T 9 Waste Exemption , a new Standard Rules Permit has been put into place. The new permit is a SR2012 No11 : Small Metal Recycling Facility (less than 5000 tonnes per year). If you choose to carry on this waste activity after the exemption has been removed , you will be doing this illegally. Therefore , it is important that you put plans in place now to prevent your business being affected. The need for a WAMITAB/CIWM Qualified Manager at waste sites. As a Legal Operator of a waste site you are required to prove that you will have technical competence in place. You can either meet the requirements of the WAMITAB/CIWM Operator Competence Scheme or be a member of the EU Skills scheme. To meet The requirements of the WAMITAB/CIWM Scheme , technically competent people must demonstrate competence by completing a qualification , units and/or training programme to demonstrate the skills and knowledge to ensure permitted sites stay compliant. Most commonly you will hear technically competent people referred to as “WAMITAB Holder’s” , “TCM’s” and “COTC Holder’s” Here at Hart's Waste Consulting , we have experienced WAMITAB holders who can offer temporary or long term technically competent cover for your waste site.
