It is an offence to operate a waste facility without an Environmental Permit.
Facilities which could harm the environment or human health need to be regulated.
The Environmental Permitting (England and Wales) Regulations 2016 require operators of "regulated facilities" to obtain an Environmental Permit or where criteria is met , a Waste Exemption.
Hart's Waste Consulting offer permitting support from applying for Waste Exemptions through to full waste management licence / Environmental Permit applications.
Applying for any kind of site waste license can be daunting , which is why we work with you to establish your future plans to get it right first time.
We work with you to come up with the best type of license type you need - saving you time and money!
Regulatory Position Statements cover a small amount of waste operations which do not require an environmental permit or waste exemption.
More information on RPS can be found on the Environment Agency Website
Waste Exemptions are for operators who are exempt from needing an Environmental Permit but must still comply with specific restrictions and conditions.
More information on Waste Exemptions can be found on the Environment Agency Website
SR Environmental Permits are for site which can operate within certain set conditions , tonnage limits and controls. Anything outside of this set criteria will require a Bespoke Permit or Installation.
Bespoke Environmental Permits are for those who cannot operate within the conditions of a SR Permit. The bespoke permit it tailored to your site operations and activities.
More information on Bespoke Environmental Permits can be found on the Environment Agency Website
During our initial call with you we will find out about what your plans and intentions are.
Our main objective during this stage is to get the information to establish what kind of permit is required. The permit type depends on what waste you intend to accept , how you want to store and treat it as well as your site type , condition and location.
We fully expect you to have lots of questions yourself , which is great because we want you too!
This stage involves screening the site you have , establishing the best permit for you and working out the costings involved.
The screening process includes checking the sites location in relation to Environmental , Nature and Heritage Sites / Constraints. This information will enable us to decide what type of permit can be applied for - for example Waste Exemption , Standard Rules Permit or Bespoke Permit.
Our aim is to have this information and a proposal back to you as soon as possible. After this , it's up to you to decide if you would like us to proceed with the waste permit application.
Once the type of permit has been agreed on , we will visit your site to gather all information required to prepare the required documents for the application.
This is a chance for you firstly meet you and for you to show us your site , where you plan to carry out specific operations and discuss any further plans before the application is prepared.
For waste permit applications, a lot of documentation is required to show you will have all necessary controls in place to prevent pollution and harm to the Environment and Human Health. These documents are prepared by us using the the information we have gathered speaking to you and during the site visit but also using our technical knowledge.
Documents to support the environmental permit application normally include:
Any management systems we prepare for you will be developed specifically for your site , and therefore ready to use when your permit is granted.
Once all the documents have been prepared and finalised we will submit this to the Environment Agency on your behalf.
Stages the Environmental Permit application process can go through:
Duly Made - the application has been properly and all information has been received to determine the application
Determination Period - the regulator will review all the information within the application and decide if they are satisfied the applicant has met all statutory requirements.
Schedule 5 Notice - sometimes this may be issued if more information is required. This notice stops the application process until they receive the information they require.
Granted - the application has been successful and your site has been approved to start operating within the permit conditions.
Of course , applications can also be refused. However , if we think that your site/operation would be at risk of a rejected application , we would inform you of this at the initial stages and advise on further consultations before applying.

Environmental Permit costs for waste differ , a lot!
The Environment Agency have published a 250 page charging scheme document which can be viewed on their website.
The best way to get an exact cost of a waste permit is to give us a call to discuss.
This depends on the type of activities , waste types and quantities you plan to carry out.
If you deal with small amounts of certain wastes you may be able to register a waste exemption , however for a broader range of waste , larger quantities and more flexibility - an Environmental Permit may be the best option.
Waste licenses / Environmental Permits can be applied for through the permitting process with the Environment Agency.
There are various forms to complete , documents to provide and fees to pay.
The Environment Agency have published guidance on how to apply for a Standard Rules Environmental Permit which gives you an idea on the process.
